Goma : Le président du TGI Wonga Okongo Alphonse administre des coups à l’avocat François Katumwa Bisimwa en public
La scène s’est passée le jeudi 02 avril 2020 à 11heure 30 au tribunal de grande instance de Goma (Nord-Kivu) devant la salle d’audience avant le démarrage d’un procès qui devait opposé la cliente Me François Bisimwa à une autre partie. Me François Bisimwa s’est vu en premier lieu agressé par le garde du corps du président de la TGI avant que ce dernier lui-même ne le roue des coups devant d’autres avocats, des justiciables et autres curieux.
Contacté par le groupe de presse LA REPUBLIQUE.net un juriste qualifie cette attitude d’infraction de droit commun. « Il s’agit des coups et blessures passibles servitude pénale de huit jours à six mois et d’une amende de vingt-cinq à deux cent zaïres ou d’une de ces peines seulement selon le code penal congolais. En cas de préméditation, le coupable sera condamné à une servitude pénale d’un mois à deux ans et à une amende de cinquante à cinq cents zaïres. Un chef de juridiction, mettre la main sur un avocat est une faute déontologique grave. Le bâtonnier et tous les avocats devraient s’indigner et porter plainte ».
Un avocat traumatisé
« Je suis psychologiquement affecté et traumatisé a la suite de ces coups et c’est une humiliation » explique Me François Katumwa Bisimwa. « Le président du TGI a tonné sur moi par rapport à la correspondance de dénonciation de ma cliente adressé aux autorités nationales. Il estime que c’est moi qui ai écrit cette correspondance pour la dame. Son policier m’a ravi le téléphone car le président estimait que je l’enregistrais avec mon téléphone. Il se vante d’être intouchable, ayant aussi des parapluies à Kinshasa et que bientôt il sera promu malgré cette dénonciation.
Son escorte a sauté sur moi avant que le président lui-même ne me prenne par la nuque et me gifle, arrachant les boutons de ma chemise devant témoins. Il a ordonné l’établissement d’un procès verbal de saisi de mon téléphoné que j’ai finalement récupéré à 16h 30 mais un téléphone endommagé qui ne fonctionne plus comme avant « , relate Me François Bisimwa.
Un dossier judiciaire qui devient personnel
Maitre Katumwa Bisimwa François nous a confié que tout est parti de la correspondante de madame Kanyere VIATSUKALUVA qui s’est indigné du comportement du magistrat WONGA OKONGO Alphonse, Président du Tribunal de Grande Instance de. Goma, adressée au président de la République Démocratique du Congo, magistrat Suprême de la RD. Congo, au vice Premier Ministre, ministre d’Etat, ministre de la Justice et Garde des sceaux de la RDC, au président de la Cour Constitutionnelle et, président du Conseils Supérieur de la Magistrature….. l’ accusant de corruption, et d’avoir craché sur l’État de droit prôné par le chef de l’État Félix Antoine en ville de Goma.
Le dossier troublant qui met le président du TGI dans tous ses états
Cette lettre d’indignation de madame Kanyere Viatsukaluwa adressée au président de la République Démocratique du Congo, magistrat Suprême de la RDC en date du 3 mars 2020, « dénonce le comportement indigne et irresponsable du magistrat, qui selon elle, se comporte tantôt comme un empereur, tantôt un roitelet et gérerait le tribunal de grande instance comme sa propre plantation de canne à sucre. Cette situation serait aujourd’hui à la base de plusieurs conflits entre justiciables et personnalisant les dossiers des justiciables rien que pour besoin de l’argent. Il justifie tout cela au nom de sa hiérarchie de Kinshasa, en violant sévèrement la constitution congolaise et la bonne démocratie prônée par le chef de l’État Félix Antoine Tshisekedi ».
Mademe Kanyere rappelle au Secrétaire permanent qu’en date du 27/10/2017 par sa lettre sans numéro, lui adressée dont l’accusé de réception était du 10/11/2017, sous le numéro d’enregistrement 2716, dont copie a été réservée au président de la Cour Constitutionnelle sous 19320, au ministre de la justice sous 15116, au Premier Président de la Cour de Cassation sous 8386, cette citoyenne de Goma avait dénoncé le caractère corruptible de monsieur Wonga Okongo dans son dossier RC 18635 que ce dernier ne donne raison qu’à la personne qui donne de l’argent, ainsi pour lui, l’argent constitue une source de droit.
Trafic d’influence
” J’aimerais dire que la juridiction que le tribunal de grande instance de Goma est une juridiction hypothéquée, et qu’il le gère pour les intérêts de sa hiérarchie, car les bavures que ce dernier commet au tribunal, avec les différentes dénonciations faites contre lui, des plaintes dans la chambre de discipline provinciale non instruites me font croire que ce dernier est un roitelet. Car au contraire ,il ne fait que dire dans la cour du tribunal tant que monsieur UBULU juge à la cour constitutionnelle et ancien secrétaire permanent du conseil supérieur de la magistrature est encore là, toutes les dénonciations des avocats, justiciables, ne produiront aucun effet, sans crainte d’être contredit” souligne Madame Kanyere dans sa correspondance.
La dame précise également que dans cette lettre que la chambre de discipline provinciale du Nord-Kivu, est saisie déjà par plus de 30 plaintes à sa charge, et plusieurs dénonciations, mais aucune d’elles n’est instruite, à tel point l’on se pose la question si cette personne a déjà pris en otage toute la hiérarchie ou soit s’il est au-dessus de la loi.
Un magistrat, électron libre
Cette dame va loin en se posant la question de savoir si le magistrat répond de quelle autorité. “J’en profite, malgré le trafic d’influence de ce dernier, porter à votre connaissance que je suis encore victime de ce trafic d’influence dans mon dossier RC 20233/20280 pendant devant le Tribunal de Grande Instance de Goma m’opposant à mon ex-époux, lequel dossier monsieur Wonga se comporte comme partie au procès, traitant cote à cote avec mon adversaire on dirait qu’il aurait des engagements et promesse dans ce dossier” dénonce et regrette en même temps la pauvre Kanyere dans sa lettre. Cette dernière poursuit sa dénonciation en précisant que cette attitude perdure plusieurs fois dans l’instruction de cette affaire, en date du 28/01/2020,
” j’ai adressé à monsieur le Greffier Divisionnaire une requête en récusation et lui sollicitant de lui notifier, aussitôt lui notifié cette récusation, au lieu d’attendre que les juges examinent cette requête, en audience publique du 04/02/2020 , il a instruit le dossier, son instruction ne portait plus sur le dossier, mais plutôt il tonnait sur moi et sur mon avocat jusqu’à me priver même la parole et à mon avocat violant ainsi le droit de la défense consacré par la constitution du pays et la charte africaine des droits de l’homme et du peuple à son point 7, mais il a préféré traité celui-ci avec les avocats de la partie adverse” ajoute elle.
Appliquer l’Etat de Droit
“Monsieur le secrétaire permanent, chose étonnante, pendant qu’il tonnait sur moi, le Président me rappelant cette correspondance pré-rappelée, et soutiendra-il qu’il est fin mandat au tribunal de grande instance de Goma, et qu’il est promu par sa hiérarchie encore président du tribunal de grande instance de Kinshasa Gombe, soit conseiller à la cour d’appel de Kinshasa Gombe, car monsieur LWAMBA est encore sous mandat comme président de la cour constitutionnelle et qu’il a déjà servi ses chefs hiérarchiques, et que d’ailleurs le récuser entant que chef de juridiction n’a aucun effet car même la composition qui connaitra cette affaire il a le pouvoir d’influencer le jugement.
Madame Kanyere dit profiter de cet Etat de droit que le nouveau chef de l’Etat et son gouvernement prônent pour lutter contre les antivaleurs et la corruption pour que justice soit faite.
